David A. Brener

David A. Brener has been practicing criminal defense for over 28 years. In that time, he has handled many thousands of criminal cases in state and federal court, including felony, juvenile, and misdemeanor cases. Mr. Brener has had jury trials in over two hundred felony cases, including first degree murder, narcotics trafficking, major thefts and frauds, sex crimes, firearms and weapons offenses, and “garden variety” felony charges. Mr. Brener has a body of work in criminal law replete with dismissals, acquittals, charge reductions, and reversals. David A. Brener is fully lead counsel qualified for representation of clients in death penalty cases, and has acted as counsel in over two dozen capital murder prosecutions where the state was seeking the death penalty. None of Mr. Brener’s clients are on death row.
Mr. Brener has handled in excess of one hundred murder cases, and literally thousands upon thousands of drug cases. He has lectured and written extensively on criminal defense issues, especially on topics related to the defense of serious felony cases, and has been published in national, statewide, and regional criminal defense magazines. David Brener is rated “AV Preeminent” in Criminal Law by Martindale-Hubbell, and is in the Bar Registry of Preeminent Attorneys. He is rated “Superb” with a 10/10 rating by AVVO.
David A. Brener is a long standing member of the National Association of Criminal Defense Lawyers, the founder and former President of the Lee County Chapter of the Florida Association of Criminal Defense Lawyers, and the Chapter Representative to the United States District Court for the Middle District of Florida C.J.A. Panel, Fort Myers Division. He is admitted to the United States Supreme Court Bar, the Eleventh Circuit Court of Appeals, the United States District Court for the Middle and Southern Districts of Florida, and the Florida Bar.
